Participation Guidelines
Berlinale and EFM 2010

1. Preliminary 

The Berlin International Film Festival (Berlinale) legally constitutes a division of the Kulturveranstaltungen des Bundes in Berlin GmbH (KBB). The Berlinale is funded by the Federal Government Commissioner for Culture and the Media upon a decision of the German Bundestag. The European Film Market (EFM) is one of the official sections of the Berlinale.
 
Accreditation to the Festival and/or registration to the EFM implies acceptance of the present rules and regulations. Any contravention of the present rules and regulations, as well as any defiance of security, order or the police, could result, if the organisation so decides, in the participant being stripped of their badge and excluded from the event for an indefinite period. The organisation also reserves the right to take legal action against the participant to recover or repair any interest or damages caused by the participant.
 

2. Conditions for Accreditation / Registration 

Accreditation / registration requests can only be processed within the notified accreditation / registration period.
 
Accreditation to the film festival / registration to the EFM is granted on the basis of the applicant's professional activity. To receive accreditation you must therefore specify the nature of your activity in the cinematographic field (i.e., exhibitors, buyers, industry professionals, filmmakers, sponsors and affiliates) or as a member of the reporting press.
 
A limited number of accreditations / registrations will be available for every category, company, and/or organization. Please note that applications neither guarantee nor represent accreditations / registrations for the Festival or Market. The organizers will give each application the utmost consideration, however, the right to grant or decline requests is at the organizers’ sole discretion, and their decision is final.
 
The accreditation / registration is valid for the entire duration of the Festival and EFM.
 
The accreditation also allows, to specific categories, access to reserved spaces and data available in password-protected areas of our website, but it does not give the right to access to receptions or private parties.

3. Badges 

Accreditation / registration is strictly personal and non-transferable. It provides access to the Berlin International Film Festival and EFM screenings (only for registered participants with either a market badge or an EFM Screening Pass) and premises in accordance with terms established by the Festival and EFM management.
 
Badges must be worn at all times on EFM premises for the duration of the EFM. EFM Security will prevent individuals without an EFM Badge from gaining access to the Exhibitor floors. If any Participant wears a badge other than his or her own, EFM Security will confiscate the badge. Confiscated badges will not be returned. Fines or other sanctions may be imposed.
 
Lost or stolen EFM or Festival Badges must be reported at the accreditation desk. There may be a 24-hour waiting period before a new badge is issued. There is a fee of Euro 50.00 for the reprint of a lost badge. The Festival reserves the right to not issue a replacement badge. There are no replacements for EFM Multiple Day Passes, Daily Passes or Visitor Passes.
 
Counterfeit badges are absolutely prohibited. If any individual is found wearing a counterfeit badge, Festival and EFM Security will escort that person off the restricted area or out of the theatre and confiscate the badge. Any Participant found to have produced, distributed, authorized or in any other way participated in the use of counterfeit badges will be subject to fines or other sanctions. In addition, the organizers may refer such individuals and organizations to law enforcement authorities.
 

4. Age Restrictions 

Accreditation / EFM registration cannot be granted to participants under the age of eighteen (18) years old due to the fact that most of the Festival screenings do not have an age rating for the protection of minors (FSK rating).
 
Exceptions can only be made for under age individuals belonging to a festival film team or participating solely in the programme of Generation 14plus or Generation Kplus. Film team and Generation participants under the age of 18 must be accompanied at all times by an adult participant who has his or her own Festival Badge.

5. Payment, Cancellation and Pick-Up 

Payments of festival accreditations cannot be made in advance but only at the accreditation counter upon collection of the badge (by cash, EC card or the following credit cards: Master Card/Euro Card, American Express and Visa).
 
Payments of EFM Badges have to be made in advance, per credit card only (with the following credit cards: Master Card/Euro Card, American Express and Visa). Refunds for pre-paid EFM Badges (Market Badges and EFM Screening Pass) can only be processed when cancelled in writing within the notified time period.
 
All Badges may be collected at the accreditation counters upon presentation of a valid form of ID, together with the accreditation confirmation letter.
 
In order to collect a badge on behalf of other participants, the proxy should present written authorization.
 
Any company or person with a debit balance to the Festival or the European Film Market will be refused accreditation / registration to the Festival or EFM and this until any debts are recovered.
 

6. Tickets 

Detailed information about ticket counters and access to screenings is handed out at accreditation badge pick-up.
 
Festival cinema tickets for accredited guests are available on the day before a screening and on the day itself. Only one ticket per screening is available and only one ticket can be obtained per film. There is a time-out between films of 90 minutes.
 
Tickets can only be picked up in person by presenting the accreditation badge and they cannot be reserved in advance. The tickets are intended exclusively for private use.
 
Tickets for accredited guests of the festival are only valid in combination with a valid accreditation badge. Badges must be held ready for inspection at the cinema entrance – otherwise access is denied.
 

7. Data Protection 

Address and contact details submitted will be electronically saved in our festival data base. To some extent these details may be published in official Festival and EFM publications, including for example the Exhibitors, Buyers and Participants Lists (print or online version), and the Screening Report (provided to Exhibitors) based on EFM Screenings attendance as well as in www.cinando.com. All badge holders, who apply before the deadline, will be included in the Festival "Who’s Where."

 

Successful accreditation / registration means the participant agrees to appear in these publications.

 

Each Participant expressly consents to receive via facsimile, e-mail or any other means, information or materials from the organizers.
 

8. Image and Sound Recording 

Visual and acoustic recordings of any kind are principally prohibited. Violations of this rule can lead to civil or criminal prosecution and visitors can be evicted from the venues.
 
In view of the need to protect all the participants at the Berlin International Festival against piracy, each participant will ensure to not, in any shape or form, violate the Intellectual Ownership act in regards to author’s rights and any other connected rights.
 
Film, digital, video or sound recordings of parts of the screenings/exhibition can be confiscated and the media can only be returned, if the owner agrees to erase the recording beforehand.
 
If image and sound recordings during a screening are carried out by authorised per-sons, the visitors agree, by their presence at the performance, that their images and words may be recorded, and that they have no right to remuneration if these are broad-cast or published.
