Film Regulations
EFM 2010

1. Selection of films 
The EFM reserves the right to prioritise films, that: 
  • are submitted by EFM Exhibitors (Stands and Offices)
  • are selected by the Berlin International Film Festival (Competition, Panorama, Forum, Generation)
  • have their market premiere at the EFM 2010
  • are produced and/or theatrically released after January 1, 2009
  • have screened in only one other international film market
 
 
Films will be excluded from participation in the EFM, if they: 
  • have already screened at the EFM or the Berlin International Film Festival in previous years
  • have screened at both the AFM 2009 and Cannes Market 2009 (Films which have screened at the Cannes Market 2009 will be programmed based on availability of slots.)
  • were produced before December 31, 2007
 
Short and medium-length films (up to 45 minutes) will only be programmed on the first two and last two days of the Market, and will be grouped in sessions of at least one hour's duration. 
 
Please note: Films that have been screened at both the 2009 AFM and the 2009 Cannes Market (MIF) are ineligible for participation in the EFM 2010. 
The organisers of the EFM refrain from any qualitative evaluation of films screened. 
 

2. Scheduling of films 

The EFM reserves the right to schedule films as it sees fit, however, we will make an effort to accommodate scheduling requests.  
Screening dates will be announced as of mid-January. 
As a rule, a maximum of two screenings per film are permitted. Participants are strongly recommended to present their films with English subtitles or in an English version. 
The EFM gives priority to feature length theatrical films. 
Programmes of short and medium-length films are only presented on the first two and last two days of the EFM
Films of 45 minutes and under will be shown in video format. 
 
3. Screening of films 
The organisers of the EFM cannot be held responsible for delays or cancellations of screenings if the technical data provided by the participants are incomplete or inaccurate, especially the running time of the film. 
In exceptional cases, the sales company may request the EFM to organize Private Screenings that have limited access and are not listed in the EFM Screening Schedule.

General Information 

1. Film Entries 
Deadline for submitting a film for a screening at the EFM is December 23, 2009. After this date the inclusion of a film in the official EFM Catalogue cannot be guaranteed. 
Film entries arriving after the deadline may only be considered according to the screening slots still available. 
Please note that exact running time is required and must include front and end credits! 

2. Prices 

Screening fees must be settled in advance, not later than February 5, 2010

All screening prices are hourly rates. Each hour started will be charged at a full hour's price. 
All prices plus VAT, currently 19 %. 
 

Cancellations 

A screening that has already been registered may only be cancelled in writing. If the cancellation is received after January 22, 2010, a cancellation fee of € 100.00 per film will be charged. If it is received after February 1, 2010, the full price of the screening will be charged. 
 

Means of Payment 

Bank transfers as well as credit cards are accepted for payment of charges. 
Eurocard/Mastercard, Visa, and American Express credit cards are accepted. 
A transaction fee of 3% of the total amount will apply to payments made with credit cards. 
 

3. Formats 

We accept: 
Film: 35 mm, 16mm 
Video: DVD, Blu-ray Disc, Betacam SP (PAL and NTSC), DigiBeta (PAL and NTSC), Mini DV (PAL and NTSC), DVCAM (PAL and NTSC), HDCAM 
All video formats will be screened from E-Cinema servers and will be therefore encoded in MPEG-MXF. 
 

4. Dispatch and Return of Films 

4.1 Deadline and late fee 

Film prints as well as video tapes and DVDs must reach us not later than February 1, 2010
For films arriving later than February 1, 2010, an additional € 50.00 fee will be charged. A standard exception will be made for all prints and tapes coming directly from festivals held before Berlin (like Sundance, Rotterdam, Gothenburg, Palm Springs). 
If a film print or video tape/DVD does not arrive at the film depot at least 48 h before its programmed screening, the organisers of the European Film Market reserve the right to cancel the screening. In this case full screening fee will be invoiced. 
 

4.2 Shipment addresses

The costs of transport, including customs fees, insurance and the costs for return freight, must be borne by the EFM clients. Should any costs of transport or customs be invoiced to the European Film Market, the amount of the bill will be invoiced to the print owner or sender plus € 25.00 service charge.

Please note that air cargo shipments will cause further costs for final delivery from the airport to our offices. For all film prints arriving from countries outside the European Single Market the Festival’s approved shipping agent and customs agent KROLL INTERNATIONALE TRANSPORTE will handle the temporary import of the prints into Germany. Film prints thus imported can only be returned or forwarded to the next destination by air freight through the same agent. 
 

4.3 Notice of Dispatch 

The sender should inform the EFM by fax or e-mail (films@berlinale.de) of the title of the film, the date and means of shipment, and the shipment number or airway bill number. 
 

4.4 Return of Film Prints and Tapes/DVDs 

Film prints and video tapes/DVDs which have participated in the EFM will be returned or forwarded to the next destination by written instructions (e-mail, fax, letter) of the print owner only, provided that the screenings fee has been paid. 
 

5. Liability 

In case of damage to or loss of a print during the Festival itself, the Festival is liable for the costs of making a new print according to the current laboratory rates for ordering a standard print.
